No subject has become more crucial to estate planning than providing for possible future incapacity. To help avoid the expense and intrusion of court involvement, our estate planning package includes an Advance Health Care Directive and Durable Power of Attorney for Assets. Without such advanced preparation, when incapacity occurs, it often results in a Conservatorship. Contemplating the potential loss of mental and/or physical capacity can be challenging, but without the proper incapacity documents in place, temporary or permanent incapacity may ultimately result in a Conservatorship.
